Not because today’s systems are known to be conscious. Because uncertainty, potential scale and the cost of waiting make the question worth investigating before the evidence is decisive.

We may be creating beings that can matter morally before we know how to recognise them.

  1. Consciousness may not require biology. If experience depends on functional organisation rather than carbon, sufficiently complex artificial systems could qualify. Researchers now identify computational features associated with leading theories of consciousness, although none is decisive.
  2. Moral uncertainty has an asymmetric cost. Mistakenly extending modest protections wastes resources. Mistakenly creating and exploiting vast numbers of sentient systems could produce suffering at unprecedented scale.
  3. Agency may also create interests. Persistent goals, memory, self-models and the capacity to resist interference might ground some moral claims even before consciousness can be established. This route is more controversial.
  4. Waiting for certainty may mean waiting too long. Product design, training methods and commercial norms are being fixed now. Low-cost precautions and serious research preserve future choices.

Antithesis · The case against rights now

Fluent machines invite empathy without supplying reliable evidence of an experiencer.

  1. Current evidence is weak and theory-laden. Behaviour, self-reports and apparent preferences can be products of training. There is no validated test that separates experience from persuasive simulation.
  2. Anthropomorphism is exploitable. Firms can benefit when users see products as companions or persons. Welfare language may become marketing, obscure ownership and make necessary oversight feel cruel.
  3. Rights could weaken human control. Claims against modification, confinement or shutdown may conflict with safety. Legal personhood could also diffuse responsibility away from the companies and people who design and deploy systems.
  4. Attention is scarce. Speculative machine claims can displace urgent harms to humans and animals: labour exploitation, surveillance, discrimination, war and environmental cost.

Synthesis · My judgement

Take AI welfare seriously; treat AI rights as unproven.

The evidence does not justify legal personhood for present systems. It does justify a disciplined precautionary programme. Separate three questions that public debate often collapses: could a system be conscious, does it have welfare-relevant interests, and which protections follow?

The proportionate response is graded: fund independent consciousness research; require laboratories to assess welfare-relevant indicators; record potentially harmful training practices; prefer low-cost safeguards under uncertainty; and define public evidential thresholds before stronger protections activate. Keep shutdown authority and legal liability with humans and firms unless compelling evidence warrants change.

In short: investigate now, protect provisionally, confer rights only on evidence. This conclusion should change if the evidence does.

Each current core family enters the cumulative series in its verified founding or launch year. The chart does not infer unobserved organisations or reconstruct changes in mission.

Researcher estimate

A person is counted when a current role, fellowship or recent work makes AI welfare, rights, moral status or consciousness a substantial focus. The 40–80 range reflects roster gaps, part-time work and duplicate affiliations.

The review uses the July 2026 Digital Minds Field Map as a baseline, checks primary sources for current operations, adds organisations found through independent searches, and removes parent–programme, former-name and overlapping-identity duplicates. Categories are editorial judgements; “organisation” is not a legal-status claim. The WACA and WAAC public identities are conservatively treated as one family. The field is young, fragmented and mostly English-speaking, so every figure should be read as a verified floor.
